Policy 3.24 - Notifications of Alcohol or Controlled Substance Violations (Beau’s Law)

Policy
In accordance with the New York State law commonly referred to as Beau’s Law, the College affirms its commitment to student health, safety, and wellbeing. While the College recognizes the potential benefits of family involvement in supporting student success, the College will not routinely notify a parent, legal guardian, or designated emergency contact when a student under the age of twenty-one is found responsible for violations of the College’s alcohol or controlled substance policies. Notification may occur in limited circumstances when there is a significant health or safety concern, a pattern of concerning behavior, or other factors indicating that outreach is necessary to support student wellbeing. Such notification would occur as permitted by the Family Educational Rights and Privacy Act (“FERPA”)
Training
In compliance with Beau’s Law, the College shall provide training to applicable employees on health and safety emergencies pursuant to FERPA and its impact on the College’s response to student alcohol or controlled substance related hospitalizations or overdoses. Applicable employees include all administration and staff with responsibilities related to FERPA compliance, student rule infractions and student discipline, controlled substance or alcohol disciplinary violations, and response to student-controlled substance or alcohol related hospitalizations or overdoses.
