Policy 2.8 - Indemnification of Officers, Employees, and Volunteers of Schenectady County Community College

Purpose
This policy defines the circumstances under which SUNY Schenectady protects individuals with respect to legal actions brought against them and outlines the procedures to be followed.
Policy
Effective October 19, 1999, SUNY Schenectady shall provide for the defense and indemnification of officers, employees, and volunteers in any civil action or proceeding, state or federal, arising out of an alleged act or omission which occurs or allegedly occurs while a covered individual is acting within the scope of his/her official duties or employment on or after October 19, 1999, subject to the definitions, limitations, qualifications, terms, conditions and intent of Section 18 of the New York State Public Officers Law.
The aforesaid defense and indemnification shall supplement and be available in addition to defense and indemnification protection conferred by any other enactment in existence on the effective date of the original resolution (Resolution #99-127).
Additionally, defense and indemnification shall be provided to the officers and employees of the SUNY Schenectady Foundation and to the officers and employees of the Faculty Student Association (FSA), provided in each instance that the governing body of the organization shall resolve to provide the aforesaid defense and indemnification and shall agree to underwrite its proportionate cost associated with provided said coverage through the College’s insurance policy.
It is the desire and intent of the Board of Trustees to provide such indemnification through the purchase of an Educators Legal Liability Insurance policy.
